WV Division of Natural Resources Files Legislative Rules for Review

The West Virginia Division of Natural Resources has filed legislative rule changes with the Secretary of State’s office, according to Frank Jezioro, Director of the Division Natural Resources. The proposed rules will be open for review and written comments until 9 a.m. on July 27, 2007. The availability of the proposed rules will be advertised in the State Register. In addition, the proposed rules will be available for review at each DNR district office, the Elkins office and the Charleston office. Individuals interested in reviewing the proposed rules should contact the Wildlife Resources Section or Law Enforcement staff at these offices.

Special Boating Rules

This legislation amends the Special Boating Rules to add Dixon Lake and Mason Lake , both at Pedlar Wildlife Management Area, to the list of lakes for special rules for government owned lakes. Dixon Lake is a new 7-acre impoundment and Mason Lake is a new 14-acre impoundment in Monongalia County . The proposed rule would prohibit boating on Dixon and restrict boating with electric motors on Mason.

Commercial Whitewater Outfitters

This legislation amends the Commercial Whitewater Outfitters rule to guarantee that each commercial whitewater outfitter who holds a license issued by the Division of Natural Resources and who uses and benefits from the additional weekend of rafting on the Gauley River pays a set mitigation fee for each customer whom the commercial whitewater outfitter transports through each study zone of the Gauley River. These amendments will assure the fair spreading of the mitigation costs of the additional rafting weekend, as well as assure adequate funding of the trout stocking program for the Gauley River in the spring and fall.
